  1. Management of Foreign Workers with Illegal Status:
    • Provides temporary stay permission for illegal or expired status foreigners from Cambodia, Laos, Myanmar, and Vietnam to apply for work and residence permits.
    • Employers must submit a list of labor demands and work permit applications, allowing foreigners to work for one year.
    • Children under 18 can stay with their parents; after turning 18, they have 60 days to apply for a work permit.
  2. Renewal of Work Permits under MOU:
    • Foreigners with work permits valid until February 13, 2568, can extend their work permit for two years, with a possible additional two-year extension, totaling four years.
    • Employers must submit the list within the deadline, and foreigners need to return to their home country or a designated location for renewal procedures.
  3. Adjustment of Work Conditions with New Employers:
    • Extends the period for finding a new employer from 30 days to 60 days after leaving the previous job.
  4. Exemption from Work Information Reporting:
    • Foreign workers are exempt from reporting work information unless there is a change in employer.
  5. Publicity and Education:
    • The Ministry of Labor, through the Department of Employment and other agencies, will conduct extensive public education to ensure employers and workers are informed about these measures.

Cabinet Resolution of September 24, 2024 on the Regulation of Employment of Foreign Workers B.E.2024

The Cabinet approved the management of foreign workers in 2567 as proposed by the Ministry of Labor, as follows:

  1. Management of foreign workers with illegal status and related draft announcements, totaling 2:
    • Draft announcement by the Ministry of Interior on special permission for foreigners from Cambodia, Laos, Myanmar, and Vietnam to stay in the Kingdom.
    • Draft announcement by the Ministry of Labor on special permission for foreigners from Cambodia, Laos, Myanmar, and Vietnam to work in the Kingdom.
  2. Renewal of work permits for foreigners holding passports or substitute documents, valid until February 13, 2568, under the MOU and related announcements, totaling 2:
    • Draft announcement by the Ministry of Interior for special permission for foreigners from Cambodia, Laos, Myanmar, and Vietnam to continue residing in the Kingdom.
    • Draft announcement by the Ministry of Labor for special permission for foreigners from Cambodia, Laos, Myanmar, and Vietnam to continue working in the Kingdom.
  3. Amendments to the conditions for working with new employers for foreigners from Cambodia, Laos, Myanmar, and Vietnam who are allowed to work in the Kingdom under the Immigration Act via MOU:
    • Based on the draft announcement by the Ministry of Labor regarding the extension of time for changing employers and the duration for working with new employers.
  4. Exemption from the duty to report work information of foreign workers under Section 64/2 of the Foreign Workers Management Act B.E. 2560 and its amendments, along with the draft announcement:
    • Draft announcement by the Ministry of Labor on the exemption from reporting work information of foreign workers.
  5. The Ministry of Labor, through the Department of Employment and relevant agencies, will conduct extensive publicity to ensure that employers, foreign workers, and related parties fully understand these measures.
